The Club House Online Membership Terms and Conditions

The Club House is owned by Other Side of the Table Pty Ltd. In these terms and conditions, ‘we’, ‘us’ and “our” refers to Other Side of the Table Pty Ltd.

Please read these terms and conditions carefully before purchasing into The Club House. By purchasing and accessing The Club House, you agree to abide by these terms and conditions.

  1. Membership Access – Your Partnership Builder

1.1. Upon purchase of your membership, you will gain access to The Club House portal and Your Partnership Builder online course content for the duration of your membership.

1.2. Access to The Club House and Your Partnership Builder program within are limited to the individual who made the purchase and is non-transferable.

1.3. You are responsible for maintaining the confidentiality of your login credentials (username and password) and ensuring they are not shared with others.

1.4. We reserve the right to terminate your membership and access to The Club House and Your Partnership Builder program if we suspect unauthorized access or sharing of login information.

  1. Membership Duration, Fees and Renewal

2.1. Your online membership to The Club House and the Your Partnership Builder Program is valid for the duration specified at the time of purchase.

2.2 Some services are billed on a subscription basis. This means that you will be billed in advance on a recurring, periodic basis (each period is called a “billing cycle”). Billing cycles are listed at the time or purchase, depending on what subscription plan you select when purchasing. Payment will be charged to your chosen payment method at confirmation of purchase and at the start of every new billing cycle.  Your subscription will automatically renew at the end of each billing cycle unless you cancel your account.

2.3 You may cancel at any time after the initial 4-month period, however refunds will not be provided for any unused services. To cancel your account, visit the My Library page, click 'Cancel Membership' and follow the prompts. IMPORTANT - Cancellation will take effect immediately and you will lose instant access to the product.

  1. Intellectual Property and Use of Materials

3.1. The Club House and Your Partnership Builder Program content is provided for educational and informational purposes only.

3.2 The copyright in The Club House, Your Partnership Builder Program and all content is owned by Other Side of the Table Pty Ltd us or licensed to Other Side of the Table Pty Ltd. All trademarks mentioned in The Club House and Your Partnership Builder Program belong to their respective owners.

3.3 We reserve all intellectual property rights, including, but not limited to, copyright in material and/or services provided. The material provided in The Club House and Your Partnership Builder Program is for personal use only and may not be re-sold and/or redistributed in any material form, stored in any storage media; and/or re-transmitted in any media, without our prior written consent.

3.4 You may view The Club House and Your Partnership Builder Program content using your web browser and electronically copy and print hard copies of parts of this Website solely for personal, non-commercial use. Any other use, including the reproduction, modification, distribution, transmission, republication, display or performance, of the content of The Club House portal and Your Partnership Builder Program is strictly prohibited. You may not modify or copy the layout and any computer software and code contained within.

  1. Progress and Completion

4.1. You are responsible for your own progress in any programs included in The Club House and Your Partnership Builder Program.

4.2. We provide guidance and support, but your success in completing the course is ultimately dependent on your effort and dedication.

4.3 Any programs included in The Club House and Your Partnership Builder are for educational and informational purposes only and any content or recommendations are not a promise or guarantee of results or future earnings.

  1. Termination of Membership

5.1. We reserve the right to terminate your membership and access to any programs associated with The Club House and Your Partnership Builder Program if you violate these terms and conditions or engage in any misconduct, as determined by our sole discretion.

5.2. Termination of your membership will result in the forfeiture of any remaining membership subscription fees.

  1. Changes made by Other Side of the Table Pty Ltd

6.1 In the unlikely event that The Club House membership or any associate programs are cancelled, changed or postponed, participants will be provided with as much notice as possible. If we are required to cancel, change or postpone a program due to circumstances outside of our control, including insufficient course enrolments, you will be offered a full refund of the total fee, or a transfer or substitution. In these circumstances we will not be responsible for any direct or indirect costs incurred by you.

  1. Changes to Terms and Conditions

7.1. We may update or modify these terms and conditions at any time. Any changes will be posted in The Club House portal, and it is your responsibility to review them periodically. The updated Terms and Conditions will apply to all new memberships from the time of posting on our website onwards.

7.2. Your continued use of the membership and in any associated programs after any changes constitutes your acceptance of the updated terms and conditions.

  1. Privacy Policy

8.1. Your use of The Club House online membership is also governed by our Privacy Policy, which outlines how we collect, use, and protect your personal information.

By purchasing and accessing our online membership to The Club House and Your Partnership Builder Program, you acknowledge that you have read, understood, and agreed to these terms and conditions. If you do not agree to these terms and conditions, please do not proceed with the purchase or access The Club House or Your Partnership Builder Program.

  1. Liability and Disclaimers 

9.1 The information contained in The Club House portal and Your Partnership Builder Program is for general information purposes only. While we endeavour to keep information up to date and correct, any reliance you place on the information is at your own risk. 

9.2 While every effort will be made to ensure that The Club House portal and Your Partnership Builder Program is kept up to date and operational, to the full extent permitted by law We disclaim any and all warranties, express or implied, regarding: 

  • the accuracy, reliability, timeliness or otherwise of any information contained or referred to on The Club House portal, Your Partnership Builder Program and/or of any linked Websites; 
  • the uninterrupted and error free operation of The Club House portal and Your Partnership Builder Program; and 
  • merchantability or fitness for any particular purpose for any service or product contained or referred to on The Club House portal, Your Partnership Builder Program and/or on any linked Websites. 

9.3 You read, use and act on The Club House portal, Your Partnership Builder Program and its content, and matters discussed at Our meetings and events, at your own risk. 

9.4 Nothing in these Terms and Conditions excludes your statutory rights as a consumer under the Australian Consumer Law (ACL) in the Competition and Consumer Act 2010(Cth). You agree that our liability for the services is governed solely by the ACL and these Terms and Conditions.

10 Indemnity 

10.1 By accessing The Club House portal and Your Partnership Builder Program, you agree to indemnify and hold us harmless from all claims, actions, damages, costs and expenses including legal fees arising from or in connection with your use of our website, Membership and Services.

11 Dispute Resolution 

11.1 If there is a dispute between the parties in relation to these Terms and Conditions, the parties agree to the following dispute resolution procedure: 

  • The complainant must tell the respondent in writing, the nature of the dispute, what outcome the complainant wants and what action the complainant thinks will settle the dispute. The parties agree to meet in good faith to seek to resolve the dispute by agreement between them at an initial meeting. 
  • If the parties cannot agree how to resolve the dispute at that initial meeting, any party may refer the matter to a mediator. If the parties cannot agree on who the mediator should be, the complainant will ask the Law Society of New South Wales to appoint a mediator. The mediator will decide the time and place for mediation. The parties must attend the mediation in good faith, to seek to resolve the dispute. 

11.2 Any attempts made by the parties to resolve a dispute pursuant to this clause are without prejudice to other rights or entitlements of the parties under this Agreement, by law or in equity.

The Terms and Conditions take effect from 1 September 2023.
